District approves lawsuit over Canvas data breach

High-risk
Los Gatos, California.

What happened

The board approved a contingency-fee legal-services agreement to pursue litigation against Instructure over a Canvas data breach. The district said it does not know what personal information attackers may have obtained, leaving a potential risk of later identity or credit fraud involving students; attorneys are paid only if the case succeeds.

Why it matters to families

The breach creates unresolved privacy and possible financial risks for students and the district, and the board is now pursuing legal recourse without an upfront legal fee.

The evidence

In the Oct. 1, 2026 meeting recording, district staff said the breach involved Canvas and that the district lacked a detailed understanding of what personally identifiable information attackers obtained (about 42:50–44:30). The board approved the Franz Law Group agreement by roll call, 4–0, on a contingency-fee basis (about 44:50–45:27).
